Will Execution Instructions

Prior to execution, print out the Will and Affidavit of Execution.

Email us if you haven’t received your Affidavit of Execution.

Please follow the below instructions to execute the will created through our tool: 

  1. Wills @ Home
    1. The will-maker and two witnesses must all be in the same room. 
    2. The will-maker puts their initials at the bottom right corner of every page of the will except for the last page, where the will-maker instead of initialing, will sign. 
    3. Witness 1 puts their initials at the bottom right corner of every page of the will except for the last page, where witness 1 will sign as a witness. 
    4. Witness 2 puts their initials at the bottom right corner of every page of the will except for the last page, where witness 2 will sign as a witness. 
    5. Note that the witnesses cannot be a beneficiary or spouse of a beneficiary under the will or under the age of majority. We also recommend that they not be executors. 

       
  2. Affidavit of Execution
    1. The will-maker should also have one of the witnesses sign the Affidavit of Execution in front of a notary/commissioner/lawyer. 
    2. The Affidavit of Execution is the document whereby one of the witnesses swears in front of a commissioner that they and the other witness were present at the time the will was executed. While an affidavit of execution is not required for a will to be valid, it is typically required when a Certificate of Appointment of Estate Trustee with a Will application is filed in an Ontario court.

Although the will can be signed without a lawyer, it is always better than the will be executed in front of a lawyer, to reduce any risks with regard to legal challenges to the will.
